A document recently published on Indonesia forum kaskus revealed that Indonesia government regulatory agency BKPM has slapped PT TVI EXPRESS INDONESIA with a finding that it is operating illegally without a direct selling license, is not operating in its described business, and has 30 days to comply or face sanctions. The decision was dated June 30, 2011.

Observer of South Africa reported that the husband and wife swindler team hawking TVI Express to members was interrupted by police investigators, and the perps were lead away in handcuffs (yes, there's a photo). Unfortunately, they posted a minimal bail (3000 Rands) when it costs 21600 Rands to join TVI Express.

Business owners and married couple, Mr Irvin Shirindzi (28) and his wife Glenda (25) were released on R3 000 bail each following a brief appearance on charges of money laundering in the Polokwane Magistrate’s Court on Monday.Their appearance follows after their business, known as TVI Express was raided by the Police last Thursday following a joint investigation by the Hawks, Limpopo Organised Crime, Limpopo Crime Intelligence and Limpopo Commercial Unit.

TVI Express is seemingly marketing a scheme to clients that has already been declared a pyramid scheme and illegal in South Africa. According to media reports, TVI withdrew from the country as of 1 January.

There are also media reports from other countries including the United States of America, United Kingdom, India and Australia regarding what has been labelled a scam.

It all boils down to people having to pay money to so-called make money and many people have allegedly been deceived by TVI Express’ "end poverty, come join us" slogan. To be a member one must pay an amount of R2 500. 

With the arrival of the Police at the business premises last week, Shirindzi was prevented from giving a presentation to his old and new clients on how the business operates and also what they will benefit if they recruit more than 15 members.

While the story cannot be confirmed, it rings true in too many ways to be a pure invention. This victim has now some VERY p***ed off friends and family members:

Stay away, if there is even an inkling of this trash network floating around. This God-awful pyramid scheme known as, Travel Ventures International Express (TVI Express), left my wife and In financial ruin last year and more recently decimated investors across South Africa having before completely disappearing and, leaving those who invested in it financially fu^%ed.

It's of little comfort to know that the The Department of Trade and Industry as well as a few other legal entities opened a police case against the company for operating a pyramid scheme. I gravely advise anyone whom has given these crooks any money at all to TVI Express to forward commissioned affidavits together with proof of payments to the Office of Consumer Protection, we need to take these slime balls down before they get rich of more victims.

There are, even now, after having been literally removed from South Africa; people promoting this garbage across the US, luring people to invest ridiculous amounts of money, and they are succeeding. My wife and I have literally begun a crusade to tell anyone who will listen to please be careful in avoiding this company, its emails, salespeople, offers, spam mail, and any informational sites whom give the company a positive slant, they are all in on it.

The guy who started it all is from India, his name is Parun Trihka and has since disappeared along with his web sites used to purchase travel vouchers. TVI Express and its criminals have lured hundreds of thousands of people to invest their money with countless promises of wealth and riches, only to leave them with nearly nothing in many cases. If there has ever been a prime example of a Ponzi scheme, this would be it.

My wife and I had purchased a non refundable voucher worth $700 to become members, further having to recruit two more people to buy the vouchers ( we foolishly chose friends and family members whom have since stopped speaking to us and will not accept our apologies) in order to move up and increase our level.

Our second review to review is "TVI Express Review - Is TVI Express Just Another Fly by Night MLM Company, Or is TVI Legit?". Gee, that's a mouthful. It is available at

The author is a TVI Express member. If you click on the link he provides at the end, it goes to his customized TVI Express recruiting website. Thus, if he said good things about the company, you'll have to take it with a grain of salt, as you cannot be sure of his motivation.

So what about the article? From his conclusion, his purpose was to demonstrate "TVI Express is NOT a scam." Let us see how well he argued.

First justification = strawman

He claims that TVI Express is not a pyramid, because...

First of all lets define what a "pyramid scheme" is. A pyramid scheme is a business model that involves recruiting people into a so called opportunity through and exchange of money with no product or service being delivered.

Unfortunately, that is nowhere CLOSE to what a definition of a pyramid scheme is. He is describing a regular scam, where your money is taken and you got nothing back, not a pyramid scheme at all.

The service that TVI Express provide is access to a dynamic travel membership. Membership owners are able to book flights, vehicles, hotels, and cruises at discounted prices. Members also get a 6 day 7 night vacation to the destination of their choice which includes a free return flight for one when they join. So from this aspect I feel comfortable in saying that this is not any type of pyramid scheme or cash gifting program.

His argument can be restated as follows:

1) Pyramid scheme is recruit people into something which delivers nothing
2) TVI Express does NOT deliver nothing
therefore
3) TVI Express is not a pyramid scheme

Unfortunately, this is a strawman, because he basically INVENTED this definition of pyramid scheme. I'll just cite Federal Bureau of Investigation's definition... again

Pyramid schemes, also referred to as franchise fraud, or chain referral schemes, are marketing and investment frauds in which an individual is offered a distributorship or franchise to market a particular product. The real profit is earned, not by the sale of the product, but by the sale of new distributorships. Emphasis on selling franchises rather than the product eventually leads to a point where the supply of potential investors is exhausted and the pyramid collapses. At the heart of each pyramid scheme there is typically a representation that new participants can recoup their original investments by inducing two or more prospects to make the same investment. Promoters fail to tell prospective participants that this is mathematically impossible for everyone to do, since some participants drop out, while others recoup their original investments and then drop out.

So we can conclude this first explanation is useless, and an outright fallacy.

Wait a minute... that's it?

Yep, that's it. The author has offered NO OTHER justification for his premise. He described some aspects of the company, and some of the background, which came straight out of the promotional material provided by the company. There was no attempt to independently verify the information, or any additional research. He basically parroted the info.

Then he threw in some personal opinion backed by nothing:

My Opinion When I first heard about TVI Express, I really paid it no mind, as I am a network marketer I hear of new companies and so called pre-launch opportunities every day. As the company started to grow I took a closer look. Their business model is unlike any other company that I have seen in the industry which is a good and a bad thing. Its good in that it makes them unique from all of the other opportunities out there however, when a company has a business structure that is this different it can be meet with a lot of skepticism. Ultimately I think TVI Express will do very will because of its revolutionary compensation plan and since it revolves around every distributor only having to recruit 2 people I foresee many people being successful in this business even with no prior marketing experience.

At least he is honest enough to say it's his own opinion, not fact. Unfortunately, it is obvious he had never seen a scam before, because the "2x3 matrix" is just a copy of the "airplane game" in the 60's and 70's. It's not only NOT revolutionary, it's ancient.

I prefer to believe that he honestly do NOT know what he's doing, because if he *did* knew that it's a scam, then he had willfully engaged in fraud.

Conclusion = FAIL

The author gave only ONE argument to support his premise that TVI Express is legit. Unfortunately, he gave a strawman argument that is easily debunked. He did not use a commonly accepted definition of pyramid scheme, but instead invented his own. He sabotaged his own argument.

This article is representative of typical arguments trying to prove TVI Express is not scam. By using logical fallacies these TVI Express members fail to make their case.

One of the biggest problems with TVI Express main website is they have no 'product' section, because they even stated very clearly "you do not have to sell any products" in their own FAQ. So what do the Indonesian website do? They added a section called products/ services.

But what does it say? It says TVI Express sells travel!

Company engaged in the field of TRAVEL AGENT, TVI Express provides a product that is associated with SERVICE FOR TRAVEL

If TVI Express sells travel, why is TVI Express Indonesia claims they do NOT sell travel? Their registered business is "computer hardware, parts, and consultancy".

Then it gets really bizarre, because one sentence don't follow the next. 

TVI Express provides discount to its members, if you want to use the services of TVI EXPRESS.  

Okay, so I sell travel, and if I want some of the discounts, I can buy at a discount myself. Great... However, why does TVI Express FAQ #3 says "You do not need to sell any products"?

Besides, TVI Express also provides business opportunities for its members to improve Traf life, to increase revenue, in order to live well with a better quality of life.

So what exactly is the business opportunity? How much travel do I have to sell to improve life?  

Income earned by the members is the result of hard work has been done, with a share and sell products TVI Express International.

This is where the translator fails me. I couldn't quite tell what exactly is the meaning of this sentence. Is TVI Express the product? Or is there some OTHER product you're supposed to sell for TVI Express?

Since the official tviexpress.com states "you do not have to sell any products", the only conclusion one can logically reach is TVI Express itself is the product. Or more concisely, YOU the members are the product. It's a pyramid scheme / money game where members are recruited so older members get more $$$ out.

But wait, there's more! He then posts a screenshot of an e-mail, claiming this is "proof" that you can make a reservation in TVI Express.  So let's take a closer look:

Did you notice something? The email is from himself to himself.  Does that prove anything? Of course not!

Furthermore Solid Trust Pay stopped doing business with TVI Express in April 2010.

Even more interesting item... TVI Express was charging $150 USD for 'taxes' in April 2010, LONG BEFORE they announced they are charging $150 for "taxes and processing fees" in June 2010!

So this guy was actually stupid enough to pay $150 for a "free" trip!

And what exactly does this prove? Nothing. He hadn't actually GONE on the trip. There's no proof of THAT. I can type this up in email easily. Since he hadn't paid that $150, it wasn't even confirmed yet, or have a booking number, or such. 

But wait, there is more!

 

So what did this prove? This proves that Ms. Goernawan (head TVI person in Indonesia) allegedly booked a hotel room to Australia. Is there any proof to link this with TVI Express? None.

Furthermore, even if this is linked to TVI Express, all this proves is the booking system TVI Express used works. It doesn't prove that the BUSINESS MODEL TVI Express uses works at all.

One last item... The guy then pulls out the infamous "travel logos" and claim all these famous companies do business with TVI Express. Clearly this guy did not read the news out of Spain... That Marriott, Lufthansa, and one other entity sued TVI Express to stop them from using their logos or claim them as partners.

Thus, you can see that the Indonesian members of TVI Express had performed NO due diligence at all, and their uplines are telling them lies, more lies, and damn lies. 

Rudy Phan claims He (and Indonesians) cannot be Responsible for TVI Express Treachery

Guess what was Rudy Phan's response? Instead of defending TVI Express, he basically claimed the local leaders CANNOT be responsible unless critics find specific law stating so.

When we follow a business, yes we should know their rights and obligations. Now I want to ask, whether in the regulation TVI Express there is a statement saying that if TVI Express is bankrupt (either because of deceptive, etc..), Then leader should be responsible?

Or, you can research ANY MLM company registered in APLI, is there a statement that if the company went bankrupt (either because of deceptive, etc..), Then leadernya should be responsible?

Please answer the questions above.

If you can not answer the above questions, then you really do is incitement and defamation. Therefore, you must also dare to account for what you've said so far. Ok?

Gee, I thought earlier he said what happens in Indonesia is governed by Indonesian law?

So if Rudy Phan recruited downlines in Indonesia, that happened in Indonesia, yes? So why should Rudy Phan not be held responsible? If PT TVI Express (Indonesia) is declared a pyramid scheme / money game, why should Rudy Phan, Ms. Goernawan, and others NOT be held responsible?

Or should Rudy Phan be tried under INDIAN law or Cyprus law if TVI Express be declared illegal in Indonesia?

I can tell you now Cyprus law says TVI Express is a pyramid scheme. Cyprus has same law as European Union.

I can tell you now that Indian law ALSO says TVI Express is a pyramid scheme. In India it is called "Prize Chit and Money Circulation scheme Banning Law".

That is the danger of international scam... The different locals take the fall for the true mastermind behind the whole thing. And Rudy Phan is IMPLYING that the local leaders cannot be held responsible.

Well, Rudy Phan... if your local government cannot get their hands on the real mastermind... They sure can get their hands on YOU AND YOUR UPLINES.

Rudy Phan Claims He Understands English Better Than English-Speakers

On the day before Christmas, Rudy Phan posted yet again claims he understands more about TVI Express than TVI Express itself. And of course, he claims I don't understand TVI Express.

One of the most diligent to write and speak ill of TVI Express is a blog Kasey Chang (http://kschang.blogspot.com/).  He did not understand what it TVI Express product.  In fact, he could not understand what is meant by "You do not need to sell any products" (http://www.tviexpress.com/faq.php). [Note: So, people who can speak English is not necessarily able to understand what is written in English].

All that insult, only to cover up one fact: TVI Express itself states very clearly in its FAQ: "You do not need to sell any products" (but you do need to recruit at least two people, and you earn money by doing that"). So what does Rudy Phan say about this VERY OBVIOUS statement? Rudy Phan claims there is a product, and TVI Express is very clear about it.

What does Rudy Phan think "You do not need to sell any products" is supposed to mean? He claims it actually means "Yes, there is a product."

Does that even sound SANE to you?

Also, did he just insult tviexpress.com website? Is he claiming that he knows TVI Express business BETTER than TVI Express themselves? I believe he did. Is that delusion of gradeur, or just complete and total madness? You be the judge.

So what sort of company is Rudy Phan claiming TVI Express to be? He actually stated that TVI Express is an "EVENTS COMPANY".

The word "a package" I replace with " events “. The word "a package" I replace with "Events". Yes, this is where the key to understanding what TVI Express product correctly. Yes, this is WHERE the key to understanding what TVI Correctly Express product. Since I already explained at length the problem TVI Express business systems in other articles, on this occasion I would like to explain the position of product vouchers in this Express TVI business.

Okay, that quote is accurate, but clearly, Rudy Phan ignored all the OTHER indications in the TVI Express website, or even on the SAME WEBPAGE:

Furthermore, have you considered what are those events for? The Events are for existing members AND are also RECRUITMENT DRIVES.  Furthermore, this is ONLY FOR MEMBERS, and only SELECTED members, not all members. This is very clearly another part of the scam... dangle this "trip" in front of you, as a "bonus package" for your recruitment efforts. And sold nothing.

This clearly proves that

1) TVI Express is not even very clear on what it really is. It claims to be network marketing in one page, home-based business in another, and as Rudy Phan pointed out, "events company" in another.

2) Rudy Phan ignores evidence that does not fit his theories, even when it's OFFICIAL like from tviexpress.com, the OFFICIAL TVI Express website.

Do you really need to read the rest of his lies?

TVI Express "press release" printed as news in Indonesia

Apparently TVI Express "distributors" (of nothing) in Indonesia is willing to pay reporters to print their "press release" as "news" about how prosperous they will be. In 2010 we saw several examples of such "articles" printed by various small local papers who basically got a ONE-sided story. Here is one example, fresh off the press (again, Google Translate-d). The fact is every one of those people have been recruited, and NOTHING has been sold. Instead, the members BUY things. How do you make money by buying things? You do not! It is a "money game", as it is referred to in Indonesia.  Entire article is an "attaboy" article, completely self-congratulatory, offers NO useful information (in fact, misleading information) about TVI Express, and because it is printed in a local newspaper, gains automatic "credibility".

Rudy Phan makes another TVIExpressdollar.com lie, about jurisdiction of disputes

Image via WikipediaTVIExpressdollar.com, a website by Indonesian TVI Express distributor "Rudy Phan", continue to post bull**** on his website, adding more and more lies hoping to recruit more participants to make himself rich, even though local businesses, governments, and even the Islamic Council have declared TVI Express a "money game" (i.e. SCAM). Rudy Phan, of course, has a comeback for each and every one of those news of "doom"... Everybody else must be mistaken. Only he can be right.

Just recently he posted a blog entry about how TVI Express is not really subject to Indonesia law.

In the entry "Rules of the Game" he posted that...

"And all disputes governed by the laws of Cyprus and India. Platform or online business systems TVI Express builds upon the laws of Cyprus and India, therefore in case of dispute will be settled in accordance with the laws of Cyprus and India. It's not that Indonesian law does not apply. The problems that occurred in Indonesia and it will be completed nationwide by the laws of Indonesia. However, because businesses are global TVI Express (you can have many members in your network who are in the world), if there are problems that are global as well, then the law is the law used Cyprus and India."

First, is Rudy Phan a lawyer? Does he even explain just WHAT laws apply in cases regarding international disputes? No! He simply issues declarations, but he has no evidence that his declaration is true! 


Second, can he explain just exactly WHAT is considered national or International? No. It's a generic "problems that occur in Indonesia is governed by laws of Indonesia". However, he quickly followed with "because the TVI Express is global, if problems are global then you must use Cyprus and India law". 


But what exactly constitutes a "global problem"? Does he mean problems with other members residing in other countries? Or with TVI Express itself? Or something else entirely? I assure you it is NOT covered anywhere in the blog, and in any case he has NO authority to make such an interpretation at all (neither do I, but then I recognize my ignorance when it comes to law, and Rudy Phan does not!)


Third, Rudy Phan claims that if you register with eBay, you are subject to the laws of California, USA. However, there a couple problems with this comparison. Here's the policy in question:

"By using eBay (including eBay.com and its related sites, services and tools), you agree to the following terms with eBay Inc. and the general principles for the websites of our subsidiaries and international affiliates. If you reside outside of the United States, you are contracting with one of our international eBay companies: In countries within the European Union, your contract is with eBay Europe S.à r.l.; in all other countries, your contract is with eBay International AG. If you have any questions, please refer to our help section."

Noticed anything? eBay has at least three offices, and it was very clear on WHICH one you are doing business with. If you are in the US, you are doing business with eBay (USA). If you are in E.U, you are doing busienss with eBay Europe, and in other countries, eBay Intl AG. 


So what this really say is if you sue eBay and you're in the US, THEN you are subject to California law. 


If you are in UK, you are subject to BRITISH COURT JURISDICTION, according to ebay.co.uk  "Any claim, dispute or matter arising under or in connection with this Agreement shall be governed and construed in all respects by the laws of England and Wales. You and eBay both agree to submit to the non-exclusive jurisdiction of the English Courts." But your contract is still with eBay International AG (based in Switzerland)

Furthermore, Rudy Phan claims that eBay Indonesia makes you subject to laws of Singapore. So TVI Express can make you be subject to laws of Cyprus and India. That is a false comparison.

If you actually click on the website, id.ebay.com user agreements, it actually takes you to http://pages.ebay.com.sg/help/policies/user-agreement.html?_trksid=m40  (the Singaporean site, which is where eBay has the closest office) 

So this basically proves that Rudy Phan has no f**king clue what he's talking about. If you do business locally, you follow local business laws. You can't just say I do business here but if there's a problem you have to sue me somewhere else.

Furthermore, the bull**** about "disputes subject to India or Cyprus law is just that, bull****.

This is the same sort of bull**** TVI Express distributes claimed in Africa. They claim they have "global license", and local regulators are NOT amused, and it is charged as illegal scams in multiple countries in Africa.

Bangledeshi MLM Veteran Calls TVI Express a Scam on Newspaper

But a section of unscrupulous gang is cheating people by offering big returns, Hossen claimed.

He points fingers at unipay2u, TVI Express, Visa Ray, Speak Asia, Legend Venture, Unigateway, Goldtrend, Neway and Destiny-2000 Ltd.

Many companies have already folded up, he said.

Government of Bangladesh is working on regulations for the MLM industry. In 2009, an anti-money laundering law was passed, which prevents any non-bank from banking activities. Furthermore, Central Bank of Bangladesh has issued warning against ANY MLM that promise excessive profits.

Which brings up a couple interesting points...

1) TVI Express is already in trouble in Africa, namely, South Africa, Namibia, and Swaziland. It is declared pyramid scheme in South Africa, and was under investigation in Namibia and Swaziland for pyramid scheme and illegal banking. Thus, the chance of it getting into trouble in Bangladesh regarding "banking", should be "very high".

2) Almost 90% of Bangladeshis are Muslims. You think the fact that Indonesian Islamic Council's declaration that TVI Express is a "money game" would have effect on the Bangladeshi Muslims?

Another Rudy Phan / TVI Express Dollar lie busted: TVI Express *is* a pyramid scheme

He said TVI Express is not MLM when TVIExpress.com website says it is MLM. 

He said TVI Express is not Ponzi scheme by utilizing 6 different false arguments. 

He said the border of London is flexible: as long as TVI Express is NEAR London it can claim to be IN London.

There are plenty more of his lies.

Today, we will bust another one of his lies, when he twisted words and claimed that Indonesia Direct Selling Association (APLI) doesn't know what they are talking about. 

The story basically goes as follows. APLI issued a warning on their website that says community must beware of pyramid schemes disguised as ("under the pretext of") MLM. 

So what was Rudy Phan's response? 

I have already stressed from the beginning, that TVI Express is NOT MLM.o, TVI Express is not a pyramid system and also not MLM. The words "under the pretext of MLM" It was assumed that the MLM is good while others (the pyramid) is bad.That applies to the pyramid system, but does not apply to TVI Express. Because, in my opinion, TVI Express system is better than MLM, therefore no need to impersonate TVI Express MLM.

So Rudy's explanation on WHY TVI Express is not a pyramid? "Because I said so. I say TVI Express is BETTER than MLM, so it doesn't need to pretend to be MLM."

This statement is DIRECTLY against statements on TVIExpress.com website where it repeatedly refer to itself as MLM or Network Marketing. Furthermore, this interpretation is purely Rudy Phan's invention. He has no evidence backing up this claim at all. You cannot "prove" an opinion with another opinion.
